1) About these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Event Campers website (event-campers.com), including all content, tools, booking widgets, and services provided through the site (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Event Campers is a trading name of ROAVER Pty Ltd, ABN 54650745994, registered in New South Wales, Australia.

2) What we do: booking agent and comparison platform

Event Campers is a motorhome and campervan rental comparison and booking platform. We connect travellers with third-party rental operators and facilitate bookings on their behalf.

We are not:
– A travel operator, tour operator, or transport provider.
– A motorhome or vehicle owner, operator, or insurer.
– A provider of roadside assistance, vehicle maintenance, or accommodation services.
– A ticket seller or event organiser. We do not sell or issue event tickets, camping passes, or any admission to events or venues.

If a festival, race, or venue requires tickets, camping passes, vehicle passes, or any other form of entry, you must purchase them directly from the official event organiser or authorised seller.

3) Rental operator terms

Each rental operator has its own terms and conditions, cancellation policies, fees, deposit requirements, insurance options, excess/bond amounts, driver and age requirements, and vehicle use restrictions.

When you make a booking through Event Campers, your contract for the rental vehicle is directly with the operator, not with Event Campers. You must read and accept the operator’s terms before finalising any booking.

Any disputes regarding the vehicle, rental charges, service quality, damage claims, insurance, refunds, or cancellations are between you and the operator. Event Campers will use reasonable efforts to assist where possible but is not a party to your rental agreement.

4) Event and destination information disclaimer

Our event and destination pages are provided for general informational purposes only. We research and present information such as dates, locations, camping options, facilities, distances, driving tips, and related details in good faith. However:

– Event details including dates, venues, lineups, camping rules, ticket requirements, and policies can change without notice.
– Destination information including road conditions, campground availability, regulations, and pricing may change over time.
– You are solely responsible for verifying all event and destination information with the relevant event organiser, venue, campground, or local authority before travelling.
– Event Campers is not liable for any loss, cost, or inconvenience arising from reliance on event or destination information on our website, including but not limited to date changes, venue changes, cancellations, policy changes, or admission issues.

5) Quotes, availability, and pricing

– Availability and prices displayed on our website are provided by rental operators and booking partners. They are indicative and may change at any time until a booking is confirmed in writing or at checkout.
– Additional fees including but not limited to insurance, excess reduction, mileage charges, cleaning fees, one-way drop-off fees, deposits, bonds, and equipment hire are determined by the operator and may be payable at pickup or separately.
– Prices are displayed in the currency indicated. Currency conversions, bank fees, and payment processor fees may apply. Event Campers is not responsible for exchange rate differences or additional charges applied by your bank or payment provider.

6) Bookings, payments, and charges

– All bookings are subject to confirmation by the rental operator and your eligibility under the operator’s requirements (including valid driver licence, minimum age, acceptable payment method, and any other conditions).
– Payments are processed by third-party payment providers and/or the rental operator directly. Event Campers may or may not be the merchant of record depending on the booking flow.
– By making a booking, you authorise us and/or the operator to charge the payment method you provide for the booking amount and any applicable fees in accordance with the operator’s terms.
– Booking confirmation details will be provided by email. Check all details carefully and contact us immediately if anything is incorrect.

7) Cancellations, changes, and no-shows

– The rental operator’s cancellation and change policies apply to all bookings.
– Cancellation fees, change fees, and applicable timelines are set by the operator and will be detailed in their terms or your booking confirmation.
– No-shows, late arrivals, failure to present required documents or identification, and failure to meet the operator’s eligibility requirements are handled under the operator’s policy and may result in forfeiture of payments.
– Event Campers is not liable for losses arising from cancellations, changes, or no-shows governed by the operator’s terms.

8) Your responsibilities

You agree to:
– Provide accurate and complete information when making enquiries and bookings (including names, contact details, driver licence details, and travel dates).
– Verify that you and all listed drivers meet the operator’s licence, age, insurance, and eligibility requirements.
– Bring all required documents to vehicle pickup (driver licence, credit card, booking confirmation, and any other documents specified by the operator).
– Comply with all operator terms, local laws, road rules, traffic regulations, insurance obligations, and vehicle use restrictions in the country or countries where you are travelling.
– Inspect the vehicle at pickup, note any pre-existing damage, and report defects in accordance with the operator’s process.
– Purchase any required event tickets, camping passes, or vehicle passes directly from the official event organiser. Event Campers does not provide these.

9) Prohibited uses

You agree not to:
– Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
– Interfere with or disrupt the security, integrity, or performance of the website or its infrastructure.
– Scrape, crawl, or use automated tools to extract content or data from the website without our written permission.
– Circumvent rate limits, access controls, or security measures.
– Submit fraudulent bookings, misrepresent your identity, or attempt unauthorised access to any part of the Services.
– Copy, reproduce, modify, distribute, or republish any content from the website without our prior written permission.
– Use the Services in any manner that infringes the intellectual property or other rights of any third party.

10) Intellectual property

All content on the website, including text, graphics, logos, images, code, page designs, and compilation of content, is owned by Event Campers or our licensors and is protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, republish, or create derivative works from any content on the website without our prior written permission.

Event names, venue names, race names, and associated marks and logos appear on our website for descriptive and informational purposes only. They are trademarks of their respective owners and their use does not imply sponsorship, endorsement, or affiliation with Event Campers.

11) Third-party links, widgets, and services

The Services may contain links to, or embed content from, third-party websites and services, including:
– Booking engine widgets (Roaver)
– Payment processors
– Map providers (OpenStreetMap via Leaflet)
– Review platforms (Trustpilot)
– Rental operator websites
– Social media platforms

We do not control these third-party sites or services and are not responsible for their content, accuracy, availability, privacy practices, or actions. Your use of third-party sites and services is governed by their own terms and policies.

12) Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. This includes but is not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.

Without limiting the above, we do not warrant or guarantee that:
(a) any event information, dates, locations, schedules, or policies on our website are accurate, complete, or current;
(b) any particular rental operator, vehicle, price, or availability will be offered or maintained;
(c) bookings will not be cancelled, changed, or affected by operator decisions, event changes, weather, or other circumstances beyond our control;
(d) the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13) Limitation of liability

To the maximum extent permitted by applicable law, Event Campers, its directors, officers, employees, agents, and affiliates are not liable for any:
– Indirect, incidental, special, consequential, or punitive damages;
– Loss of profits, revenue, data, goodwill, or anticipated savings;
– Costs of procuring substitute services;

arising from or related to:
(i) your use of or inability to use the Services;
(ii) reliance on event, destination, or other information on our website;
(iii) bookings, vehicles, rental charges, service quality, damage claims, insurance, or disputes with operators;
(iv) cancellation, change, or non-availability of events, venues, vehicles, or services;
(v) third-party websites, services, or content linked from or embedded in our website.

Our total aggregate liability to you for any claims arising from or related to the Services is limited to the amount of any commission or fee actually received by Event Campers in connection with your specific booking, or AUD $100, whichever is greater.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection law that cannot be excluded, restricted, or modified by agreement.

For consumers in New Zealand, nothing in these Terms excludes or limits rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded or limited by agreement.

14) Indemnity

You agree to indemnify, defend, and hold harmless Event Campers, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from or related to:
– Your breach of these Terms;
– Your violation of any applicable law or regulation;
– Your negligence or wilful misconduct;
– Any dispute between you and a rental operator, event organiser, or other third party;
– Any content or information you provide to us.

15) Privacy, cookies, and data

Your use of the Services is also governed by our Privacy Policy and Cookie Policy. By using the Services, you acknowledge that we collect and use personal information and cookies as described in those policies, and that you can manage non-essential cookies through our cookie banner and cookie settings.

16) Suspension, termination, and changes to the Services

We reserve the right to:
– Modify, suspend, or discontinue any part of the Services at any time, with or without notice.
– Suspend or terminate your access to the Services if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or pose a security risk.

We are not liable to you for any modification, suspension, or discontinuation of the Services.

17) Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, for any disputes arising from or related to these Terms or the Services.

If you are a consumer in another jurisdiction, this clause does not prevent you from relying on mandatory consumer protection laws in your country of residence that cannot be excluded by agreement.

18) Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

19) Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Affiliate and Commercial Disclosure, constitute the entire agreement between you and Event Campers regarding your use of the Services. They supersede any prior agreements or understandings, whether written or oral.

20) No waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

21) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top shows the latest version. Where we make material changes, we will post a prominent notice on the website and/or notify you by email where appropriate. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
